These Terms of Service ("Terms") form a binding agreement between you and Lightwave Labs LLC ("we", "us", "our"), a Wyoming limited liability company with its business address at 30 N Gould St, Ste N, Sheridan, WY 82801, USA, governing your access to and use of the ThaiSabai mobile application (the "App"). By creating an account or using the App you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility and Account
You must be at least 13 years old (or the equivalent age of digital consent in your jurisdiction) to use the App. You are responsible for keeping your account credentials secure and for all activity under your account. You may sign in using Sign in with Apple or as a guest. We may suspend or terminate accounts that violate these Terms.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use, and in accordance with these Terms and the Apple Standard EULA for licensed applications.
3. Subscriptions and Payments
The App offers auto-renewing subscriptions ("Subscriptions") that unlock additional features. Subscriptions and any free trials are managed by Apple through your App Store account. By starting a Subscription you agree to the following:
- Auto-renewal. Your Subscription automatically renews at the end of each period for the same plan and price unless you cancel at least 24 hours before the end of the current period.
- Free trials. If a free trial is offered, your card will not be charged during the trial. The Subscription begins automatically at the end of the trial period unless you cancel before then. Apple will only grant a free trial if your Apple ID is eligible.
- Pricing. The current price and billing period for each Subscription is shown inside the App before purchase. Prices may vary by region and are charged in your local currency.
- Cancellation. You can cancel a Subscription at any time from the App Store (open the App Store app, tap your profile picture, then Subscriptions → ThaiSabai). Cancellation takes effect at the end of the current billing period.
- Refunds. All payments are processed by Apple. Refund requests are handled by Apple in accordance with Apple's policies; we cannot issue refunds directly.
4. User Conduct
You agree not to:
- Reverse engineer, decompile, or attempt to derive the source code of the App.
- Use the App for any unlawful, fraudulent, or harmful purpose.
- Interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems.
- Resell, sublicense, or commercially exploit any part of the App.
- Use any automated means (bots, scrapers) to access or copy content.
5. Content and Intellectual Property
The App, including its lessons, audio, exercises, designs, and software, is owned by us or our licensors and is protected by copyright, trademark, and other laws. Except for the limited license in Section 2, we and our licensors reserve all rights.
6. Privacy
Our collection and use of personal information is described in our Privacy Policy, also available inside the App under Settings → Privacy Policy. By using the App you consent to our handling of personal information as described there.
7. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy of translations, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or meet any specific learning outcome.
8. Limitation of Liability
To the maximum extent permitted by law, in no event will Lightwave Labs LLC, its officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of your use of the App. Our total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose or (b) USD $50.
9. Termination
You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms. You can permanently delete your account at any time from inside the App (Settings → Account → Delete Account). Sections that by their nature should survive termination (including Sections 5, 7, 8, and 10) will survive.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of laws rules. Any dispute arising from these Terms or your use of the App will be resolved in the state or federal courts located in Wyoming, and you consent to personal jurisdiction in those courts. Nothing in this Section limits any non-waivable rights you may have under the laws of your country of residence.
11. Apple Devices
You acknowledge that these Terms are between you and us, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.
12. Changes
We may update these Terms from time to time. If we make material changes, we will notify you in the App or by updating the "Last updated" date above. Your continued use of the App after the changes take effect constitutes acceptance of the updated Terms.
